How to file a YouTube fraud complaint in India (step by step)

By Advocate Panchanand Shaw, Bar Council of West Bengal · Published 1 Nov 2026 · Online fraud

A YouTube fraud complaint must be filed at cybercrime.gov.in or on 1930 within hours of the payment, because the money is routed through mule accounts that empty quickly. The conduct is prosecuted as cheating under Section 318 of the Bharatiya Nyaya Sanhita 2023 and, where a computer resource or a fabricated identity was used, under Sections 66C and 66D of the Information Technology Act 2000.

A YouTube fraud complaint in India begins online, not at a police counter. The National Cyber Crime Reporting Portal at cybercrime.gov.in and the 1930 financial-fraud helpline are the two doors that open first, and the reason is practical rather than procedural: money taken through a fake channel, a fake customer-care number or a fake investment pitch is moved through a chain of accounts within minutes, and every hour of delay reduces the chance that a bank can freeze what is left. Register the transaction before you write a single paragraph of explanation to anyone.

The second thing to understand is who the accused actually is. In most cases it is not YouTube. The platform is a carrier, and Google's own reporting tools deal with the account, the video and the channel. The criminal case is against the person who induced the payment and the account holders who received it. Separating those two tracks, platform takedown on one side and a criminal complaint on the other, is the single most useful decision a complainant makes in the first week.

What a YouTube fraud complaint actually covers

The phrase describes several fact patterns that share a platform but not a legal shape. A fake investment channel promises guaranteed returns from a trading bot and collects money through UPI or a current account. A cloned channel copies a bank or a broker's branding and runs a live stream pushing a fraudulent app. A fake customer-care number, posted in a video description or a comment thread, answers a genuine complaint and then asks for a remote-access app or an OTP. A hacked channel with an existing subscriber base is sold or used to push crypto and lottery schemes to people who trust the face on screen. A paid promotion sells a product that never arrives.

Each of these is cheating at its core, but the evidence differs sharply. In the fake investment case the ledger of transfers and the chat record matter most. In the fake customer-care case the call detail record and the screen-sharing session matter most. In the cloned-channel case the video URL, the upload date and a screenshot of the channel handle matter most. A complaint that names all of them without proof of any is weaker than a complaint that sets out one transaction, one beneficiary and one document per claim.

What the law says

The penal provisions are not exotic. Section 318 of the Bharatiya Nyaya Sanhita 2023 punishes cheating, and the aggravated form under Section 318(4) applies where the inducement caused delivery of property, which is exactly what a payment is. Where the offender was entrusted with property in a fiduciary or agency capacity and dishonestly misappropriated it, Section 316 of the Bharatiya Nyaya Sanhita 2023 applies instead; this is common in cases where an agent, a channel manager or a middleman handled funds.

The Information Technology Act 2000 supplies the computer-specific offences. Section 66 covers computer-related offences generally. Section 66C covers identity theft, which is the correct provision where someone used another person's electronic signature, password or unique identification feature. Section 66D covers cheating by personation using a computer resource or a communication device, and it is the provision that fits a fake profile, a spoofed handle or an impersonated official most precisely. Section 66D carries imprisonment up to three years and a fine up to one lakh rupees.

Where the fraud involved a forged document, a forged video or a fabricated certificate, the forgery provisions of the Bharatiya Nyaya Sanhita 2023 apply alongside cheating. Where the complainant was threatened after asking for the money back, Section 351 of the Bharatiya Nyaya Sanhita 2023 on criminal intimidation is added. On the procedural side, Section 173 of the Bharatiya Nagarik Suraksha Sanhita 2023 governs the registration of a First Information Report in a cognizable case, and Section 175(3) allows a magistrate to direct investigation where the police decline to register. Section 35 of the same Sanhita governs arrest, and Section 187 governs remand where investigation cannot be completed within twenty-four hours.

Evidence is where most complaints quietly fail. Section 63 of the Bharatiya Sakshya Adhiniyam 2023 governs the admissibility of electronic records and requires a certificate in the prescribed form when an electronic record is produced as evidence. A complainant who preserved a screen recording, an email header and a bank statement, and who can produce the device on which the messages were received, is in a very different position from one who forwards screenshots from a phone that has since been reset.

If money moved out of a bank account, the Reserve Bank of India's directions on limiting customer liability in unauthorised electronic banking transactions also apply. Those directions turn on when the customer reported the transaction, not on how convincing the fraud was, and they give the bank a defined period to resolve the complaint. That is a separate remedy from the criminal case and should be pursued at the same time, not after it.

Filing the complaint: the order that works

  1. Call 1930 immediately. The helpline logs a financial-fraud complaint and can trigger a request to the beneficiary bank to hold the funds. Have the transaction reference number, the amount, the date and time, the beneficiary account or UPI handle, and the phone number that was used to contact you. Do not wait for a written complaint; the call is the complaint.
  2. File on cybercrime.gov.in the same day. Choose the financial-fraud category, enter the same details, and upload the bank statement page showing the debit. The portal issues an acknowledgement number, which is the reference every later authority will ask for. Keep it with the transaction record.
  3. Write to your bank's nodal officer. Use the bank's grievance email, mark it as an unauthorised electronic transaction, give the acknowledgement number, and ask in writing for the transaction to be reversed or the beneficiary account to be frozen. A call-centre ticket is not a written complaint; an email with a date stamp is.
  4. Report the channel or video to YouTube. Use the report function on the video and on the channel, and flag impersonation where the channel copies a real brand. This does not recover money, but it stops the scheme from collecting the next victim and it creates a dated record that the content existed.
  5. File the FIR at the cyber crime police station. Take the portal acknowledgement, the bank statement, the chat and call records, and a written complaint signed and dated. Under Section 173 of the Bharatiya Nagarik Suraksha Sanhita 2023 the information must be recorded in a cognizable case. In Kolkata, cyber crime complaints are routed through the police station with cyber jurisdiction and thereafter to the Cyber Crime Police Station, and the Bankshall Court and City Sessions Court deal with the resulting cases.
  6. If the police refuse to register, move the magistrate. A written application under Section 175(3) of the Bharatiya Nagarik Suraksha Sanhita 2023 asks the magistrate to direct investigation. Attach the portal acknowledgement and a copy of the written complaint you gave the police station, showing the date it was received.
  7. Escalate to the RBI Ombudsman if the bank does not resolve it. Where the bank fails to reverse or explain the debit within the period set by the RBI directions, a complaint lies under the Reserve Bank's Integrated Ombudsman Scheme. This is free, and it runs in parallel with the criminal case.

What decides the outcome

The first factor is speed of reporting. A complaint filed within three working days of the debit stands on a different footing under the RBI directions than one filed three weeks later, and bank officials read the timestamp before they read the facts. The second is whether the money was authorised by the customer in form. If you entered a UPI PIN or approved a collect request, the bank will treat the transaction as authorised and the case becomes one of induced consent, which is a criminal question rather than a reversal question. That distinction surprises most complainants and it decides most bank responses.

The third factor is the quality of the link between the accused and the beneficiary account. Investigating officers pursue cases where the complaint identifies a specific account, a specific phone number and a specific handle. A complaint that says only that a YouTube channel cheated me gives an officer nothing to requisition. The fourth is documentation of the inducement itself: the words used, the promise made, and the point at which the payment was demanded. Cheating requires a dishonest inducement at the time of the promise, and a chat record that shows the promise is worth more than a later summary written by the complainant.

The fifth is the accused's identity. Where the channel was operated from outside India, the investigation depends on mutual legal assistance and on data preserved by the platform, and the case slows considerably. Where a mule account holder in India can be traced, recovery is realistic. Courts assess all of this on evidence, and no lawyer can promise a particular result.

Mistakes that weaken a strong case

Do not delete the chat, clear the app data or reset the phone to remove a suspicious app before the device has been examined. Do not pay a second time because a caller claiming to be from the cyber cell offers to release the first payment; that is a second fraud, and it is common. Do not send the same complaint to five authorities in five different formats, because inconsistent dates become cross-examination material. Do not name a person as the accused on the basis of a profile photograph, which is frequently stolen from an unrelated account.

Do not assume that a YouTube takedown is a legal remedy for the money. It is not. And do not let the platform's automated response substitute for the FIR; complaint numbers from Google are not police records, and a bank will not treat them as proof of a crime.

When to involve a lawyer

Most straightforward cases move from 1930 to the portal to the bank without legal help, and there is no reason to complicate them. A lawyer becomes useful when the police decline to register an FIR, when the bank rejects liability after the RBI window closes, when the amount is large enough that a magistrate's direction or a civil suit for recovery is worth the cost, or when the complainant is himself being investigated because a mule account was opened in his name. In those situations the paperwork is already there; what is needed is the correct forum and the correct section. A cyber crime lawyer in Kolkata can review the file before it is filed rather than after it is rejected, and the general framing of these matters is set out under cyber crime legal services.

Frequently asked questions

Where do I file a YouTube fraud complaint in India?

File first on the 1930 helpline and at cybercrime.gov.in, then give a written complaint at the cyber crime police station for an FIR. The portal and the helpline create the financial trail that banks act on, while the FIR creates the criminal record. Both should be done the same day, because the beneficiary account empties quickly.

How long does a YouTube fraud complaint take to resolve?

There is no fixed period. Banks must respond to an unauthorised transaction complaint within the timeline set by the RBI directions, but recovery depends on whether the beneficiary account still holds funds. Criminal investigation timelines vary with whether the accused is traceable in India. Expect weeks rather than days for a written bank decision.

Can I get my money back if I paid through UPI to a fake YouTube channel?

Recovery is possible but not guaranteed. If you report on 1930 quickly, the beneficiary bank may freeze the remaining balance. If you approved the payment with your UPI PIN, the bank will treat it as authorised and recovery depends on the criminal case against the accused.

Is YouTube legally responsible for a fraud run on its platform?

Generally no. YouTube is an intermediary and the criminal case lies against the person who induced the payment. Platform liability arises only in narrow circumstances under the Information Technology Act 2000 and the intermediary guidelines, and it is not a route to recovering the lost money.

What sections apply to a fake YouTube investment channel?

Section 318 of the Bharatiya Nyaya Sanhita 2023 for cheating, and Sections 66C and 66D of the Information Technology Act 2000 where a fabricated identity or computer resource was used. Section 316 applies if an agent or manager misappropriated entrusted funds. Where the channel also forged a brand identity or documents, the impersonation and forgery provisions are added to the charge.

Do I need a lawyer to file the complaint?

Not for the initial filing. The 1930 call, the portal complaint and the written complaint to the bank can be done by the victim. A lawyer helps where the police refuse to register an FIR, the bank denies liability, or the amount justifies a civil recovery suit.

What evidence should I preserve before reporting?

Preserve the bank statement showing the debit, the UPI or NEFT reference, the full chat and call record on the original device, the video and channel URLs with the date you accessed them, and the portal acknowledgement. Do not reset the phone or delete the messages.
