Work from home scam legal remedies and recovery routes

By Advocate Panchanand Shaw, Bar Council of West Bengal · Published 2 Nov 2026 · Court process

A work from home scam creates three separate remedies that run on different rules. The criminal complaint punishes the fraudster under BNS 2023 section 318 and IT Act 2000 section 66D. The civil suit tries to recover your money. Regulatory complaints target the bank, the platform or the company that enabled the fraud.

Most victims treat a work from home scam as one problem and look for one solution. In law it is three problems, and each has its own forum, its own standard of proof and its own realistic result. Choosing the right mix at the start saves months. Choosing only one usually produces frustration, because a criminal case can end in a conviction without returning a rupee, and a civil decree can be won against a person who has no assets left.

Take a typical case. A person in Kolkata pays ninety thousand rupees to a company that promised part-time data entry work from home. The company sends an offer letter, collects the fee into a current account, stops replying, and closes the phone number. The victim now has a cheating complaint, a money claim and a set of regulatory complaints available. What follows is how each of those actually works.

Remedy one: the criminal complaint

The criminal track is about punishment, not refund. The offence is cheating under section 318 of the Bharatiya Nyaya Sanhita, 2023. Where the promise was made and performed through a computer or phone, section 66D of the Information Technology Act, 2000 applies as well. If several people set up the fake company, section 61 of the BNS covers criminal conspiracy. A forged appointment letter or a copied company seal can bring in section 336 on forgery.

The complaint begins under section 173 of the Bharatiya Nagarik Suraksha Sanhita, 2023. Information about a cognizable offence must be recorded, and the proviso permits a zero FIR at any station, even one outside the area where the offence occurred. The station then transfers the case to the station with jurisdiction. In practice, an online complaint filed on cybercrime.gov.in often reaches the cyber cell faster than a walk-in complaint at a general police station, because the cyber cell has the account-freezing workflow.

If the police do not register an FIR, the remedy is an application to the magistrate under section 175(3) of the BNSS. The magistrate can direct an investigation. That application should attach the portal acknowledgement, the bank statement, the chat record and a short chronology. It is not a substitute for the police complaint; it is an escalation after the police have failed to act.

Once an accused is arrested, the procedural stages run quickly. Section 35 of the BNSS governs arrest, and section 187 governs production before the magistrate and remand. Bail is decided under sections 480 and 482 of the BNSS. A victim who wants to oppose bail can appear through counsel and place the transaction trail and the scale of the fraud before the court. None of this returns money on its own, though a court may order compensation as part of the sentence or under the victim compensation scheme.

The evidentiary rule that decides most cyber fraud trials is section 63 of the Bharatiya Sakshya Adhiniyam, 2023. Electronic records must be accompanied by a certificate identifying the record and the device. A prosecution that produces screenshots without that certificate risks the record being excluded. A victim who preserves the original phone, the original chat thread and the bank statement makes the investigation far easier.

Remedy two: the civil recovery suit

A civil suit is about the money. The claim is that the defendant induced a payment by a false representation, received the money, and has no intention of performing. The standard of proof is the balance of probabilities, which is lower than the criminal standard of proof beyond reasonable doubt. That is why a civil suit can succeed even where a criminal trial ends in acquittal, and why the two can run at the same time without waiting for each other.

The practical problem is not winning but collecting. A decree against a company with no bank balance and no property is a piece of paper. Before filing, a lawyer should check the corporate registry for the company's status, directors, registered address and authorised capital. If the company was struck off or never existed, the claim shifts to the individuals who received the money. That is why the bank statement matters: it identifies the account holder, not just the company name printed on the offer letter.

Where there is a risk that the defendant will sell assets during the trial, the suit can be filed with an application for attachment before judgment. The court can freeze the property or the bank balance until the case ends. This is the civil equivalent of the bank lien in the criminal process, and it is often the most useful step in a large-value case.

Limitation is unforgiving. A money claim ordinarily has to be filed within three years of the payment. A victim who spends two years waiting for the police to act can lose the civil remedy even though the fraud is obvious. The criminal complaint does not pause the civil clock.

Remedy three: regulatory and platform complaints

The third track is the one most victims ignore. The bank is regulated by the Reserve Bank of India. The 2017 RBI directions on limiting customer liability in unauthorised electronic banking transactions require the bank to act on a reported unauthorised transaction, and they give zero liability where the customer reports within three working days in a third-party breach case. If the bank refuses to investigate or delays beyond the prescribed period, the escalation is to the RBI's complaint management system after the bank's internal grievance process.

The platform that carried the advertisement or the job listing is an intermediary under the Information Technology Act, 2000. Section 79 gives intermediaries protection from liability only if they follow due diligence, which includes appointing a grievance officer under the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. The grievance officer must acknowledge a complaint within twenty-four hours and resolve it within fifteen days. A platform that ignores the complaint risks losing the safe harbour.

If the fake employer claims to be a registered company, the corporate affairs ministry's registry can be checked and a complaint made about the false use of a corporate identity. A company that never existed cannot be sued as a company, but the individuals behind the name can be sued personally.

What decides which remedy to lead with

Speed decides the bank dispute. If the payment was made in the last few days and the beneficiary account still holds funds, the bank and the 1930 helpline are the priority. A civil suit filed next month cannot freeze money that has already been withdrawn.

The amount decides the civil suit. For twenty thousand rupees, the cost and delay of a suit rarely make sense unless the same defendant has defrauded many people and a group action is possible. For ten lakh rupees, the suit and the attachment application are worth serious consideration.

The identity of the receiver decides the criminal case. A verified account in a real name gives the police a person to investigate. A rented mule account gives them a link in a chain that may lead nowhere. In mule account cases the investigation usually depends on the bank's KYC record and the device data attached to the account opening.

The strength of the written record decides all three. A victim who has the offer letter, the payment receipt, the chat thread and a dated chronology is in a very different position from one who has a screenshot of a WhatsApp message and no reference number.

What not to do while pursuing remedies

When to involve a lawyer

A lawyer is not needed to dial 1930. A lawyer is needed when the bank rejects the dispute, when the police refuse to register the FIR, when the amount justifies a recovery suit, or when you are asked to give a statement that may be used later. A cyber crime lawyer in Kolkata can map which of the three remedies is worth pursuing on your facts, draft the magistrate application and the civil plaint, and appear at the bail stage. If the accused is arrested and you want to oppose release, the bail page explains what the court looks at. The remedy that fits your case depends on the amount, the receiver and the record, not on which forum sounds toughest.

Frequently asked questions

What legal remedies exist after a work from home scam?

There are three: a criminal complaint for cheating under BNS section 318 and IT Act section 66D, a civil suit to recover the money paid, and regulatory complaints to the bank, the platform and the corporate registry. Each has a different standard of proof and a different outcome.

Can I file both a criminal case and a civil suit?

Yes. The criminal case punishes the offender and the civil suit recovers the money. They can run at the same time, and a civil court decides on the balance of probabilities rather than proof beyond reasonable doubt, so the civil suit can succeed even if the criminal trial does not.

How long do I have to file a civil recovery suit?

Ordinarily three years from the date you made the payment. The criminal complaint does not pause that clock. If you wait for the police investigation to finish before filing the suit, you may lose the civil remedy even though the fraud is clear.

Can the bank reverse a payment made to a fake employer?

It can if you report quickly. The RBI 2017 directions on unauthorised electronic transactions give zero liability where the customer reports within three working days in a third-party breach. After that the liability may be shared, and the bank must still decide the dispute within the prescribed period.

Is the job platform liable for the fake listing?

Only if it fails its due diligence. Under section 79 of the IT Act, 2000 an intermediary keeps its safe harbour if it follows the IT Rules, 2021, which require a grievance officer to acknowledge a complaint in twenty-four hours and resolve it in fifteen days.

Can I get compensation in the criminal case itself?

A court can order compensation as part of the sentence or under the victim compensation scheme, but it is not a substitute for a civil suit. Compensation depends on a conviction and on the accused's ability to pay, so a separate civil claim is often the more reliable route to the money.
