Cyber Crime Complaint West Bengal: Cyber Cell and Process

By Advocate Panchanand Shaw, Bar Council of West Bengal · Published 4 Nov 2026 · Court process

A cyber crime complaint in West Bengal is filed as an FIR under section 173 of the BNSS, at the jurisdictional police station, a district cyber cell, or the state cyber crime police station in Kolkata, after calling 1930 and filing on cybercrime.gov.in. Kolkata cases are tried before the Magistrate or the City Sessions Court, with quashing before the Calcutta High Court.

A cyber crime complaint in West Bengal begins the same way it does anywhere in India, with information about a cognizable offence recorded as a First Information Report under section 173 of the Bharatiya Nagarik Suraksha Sanhita 2023. What is specific to the state is the practical route: the jurisdictional police station, the district cyber cell, and the state cyber crime police station in Kolkata, together with the online national machinery reached through the 1930 helpline and cybercrime.gov.in. The charges themselves come from the Information Technology Act 2000 and the Bharatiya Nyaya Sanhita 2023, most often sections 66, 66C and 66D of the IT Act and section 318 of the BNS for cheating.

Two things confuse most complainants in the state. The first is the difference between the acknowledgement number a portal gives you and a registered FIR with a crime number that a bank and a court recognise. The second is the difference between a district cyber cell and the state cyber crime police station, which handle different kinds of cases. This guide sets out where to file, how a complaint is turned into a registerable case, how the investigation and the court process work in Kolkata, and the mistakes that slow down the recovery of money.

Where a cyber crime complaint is filed in West Bengal

There is no single office for the whole state. The correct starting point depends on where the offence was committed, where its effect was felt, and how serious it is.

The jurisdictional police station

The station with jurisdiction over the place where the offence occurred, or where its consequences were suffered, is the natural place to give written information. Section 173(1) of the BNSS requires that information about a cognizable offence be received irrespective of the area where the offence was committed, which is the zero-FIR facility. A station cannot refuse to receive the information merely because the accused or the offence is outside its limits; it records the information and later transfers the case to the station that will investigate it.

District cyber cells and the state cyber crime police station

Each district in West Bengal has a cyber cell attached to its police organisation, which handles offences such as online fraud, financial cyber crime, identity theft and social-media harassment arising within that district. The state cyber crime police station, based in Kolkata, handles serious, inter-district and multi-victim cases and coordinates tracing across districts and states. For offences arising within the city, the Kolkata Police cyber unit is the specialised agency. In practice, a complainant can give information at the jurisdictional station, which then routes it to the appropriate cyber unit, or approach the cyber cell directly where one operates a public counter.

What a registerable complaint must contain

A complaint is only as strong as the detail in it. Before going to any office, assemble the following, because a complete complaint is registered faster and gives the investigator something to act on.

Step by step, from helpline to FIR

  1. Call 1930 at once if money has moved. The national helpline can flag the transaction for a freeze before the funds are layered away, and speed here matters more than anything that follows.
  2. File a complaint on cybercrime.gov.in, which creates a dated national record with a reference number and can trigger a bank freeze request where the transaction was recent.
  3. Give a written complaint at the jurisdictional police station or the district cyber cell, and insist on a stamped receipt or the daily-diary entry number.
  4. If the officer declines to register an FIR, send the substance of the information to the Superintendent of Police, the remedy preserved by section 173(4) of the BNSS, and if that brings no action, apply to the jurisdictional Magistrate under section 175(3), who may order an investigation.
  5. Obtain the free copy of the recorded information and the crime number. Once the FIR exists, give the crime number to your bank so that its nodal officer can pursue a chargeback or a lien.
  6. Send takedown notices to the platform or intermediary through its grievance channel, keeping proof of each request, since an intermediary loses the protection of section 79 of the IT Act if it ignores due-diligence obligations under the IT Rules 2021.
  7. For harassment or obscene content, press for the specific sections, section 67 or 67A of the IT Act and section 356 of the BNS for defamation, so that the complaint is not filed only as a generic fraud.
  8. Track the money separately: after the bank's own timeline under the RBI directions on unauthorised electronic transactions, escalate to the banking ombudsman if the bank does not act.

How the case moves in court in Kolkata

Once an FIR is registered, the investigation proceeds under the BNSS, and the accused is dealt with according to the nature of the offence. For a cognizable offence carrying up to seven years, the police must ordinarily serve a notice of appearance under section 35 of the BNSS rather than arrest, and a person who complies and attends is protected from arrest unless the officer records reasons. Where searches or seizures are conducted, section 105 of the BNSS requires them to be recorded through audio-video electronic means. Electronic records are proved under section 63 of the BSA 2023.

In Kolkata city, the criminal work of the Magistrate sits at the Chief Metropolitan Magistrate's court, commonly called Bankshall Court, and graver matters that must be tried by a Sessions court go before the City Sessions Court. Bail in an early-stage matter of a bailable offence is a matter of right, while in non-bailable offences the court weighs the gravity and the evidence. Where an FIR is clearly an abuse of process or discloses no offence, the accused may seek quashing before the Calcutta High Court under section 528 of the BNSS, which preserves the High Court's inherent powers. Where the investigation drags beyond the statutory period and the accused is in custody, the accused may claim default bail under section 187 of the BNSS.

What decides the outcome

Timelines that matter, and who to chase

Cyber complaints are won or lost on timing. The 1930 call and the portal entry should be made the same day the loss appears, because a freeze request routed through the beneficiary bank's nodal officer has to reach the funds before they are moved again. The bank's duty is separate from the police investigation: the RBI directions on unauthorised electronic transactions require a bank to act on a promptly reported fraud and to give the customer a provisional credit within a defined timeline, and they limit the customer's liability where the fraud is reported within the prescribed period. That is a customer-service remedy you can pursue through the bank and then the banking ombudsman, independently of the criminal case.

On the police side, where the offence carries three years or more but less than seven, section 173(3) of the BNSS allows a preliminary enquiry, but it must be completed within fourteen days and is not a substitute for investigation. If the case reaches trial, it is heard by the Magistrate on the electronic record proved under section 63 of the BSA. Where a person is in custody and the investigation is not completed within the statutory sixty or ninety days, section 187 of the BNSS gives a right to default bail. Knowing which timeline applies tells the complainant and the accused alike what to expect next.

Common mistakes in West Bengal complaints

When to involve a lawyer

A cyber crime complaint in West Bengal is a procedural task as much as a factual one, and the choice between a district cyber cell, the state cyber crime police station and a direct complaint to the Magistrate affects how quickly the case moves. A lawyer experienced with the state machinery can help frame the complaint under the correct sections, prepare the electronic-evidence certificate, and pursue escalation when a station stalls. If you need support specific to the state, see the practice on cyber crime lawyer in West Bengal, or start with a cyber crime lawyer in Kolkata to work out the correct forum and sequence. For the practical Kolkata services, see cyber crime lawyer services in Kolkata. If you are the person accused, the same understanding of the BNSS process is what protects your position from the first notice.

Frequently asked questions

Where do I file a cyber crime complaint in West Bengal?

You can give written information at the jurisdictional police station, at the district cyber cell, or at the state cyber crime police station for serious and inter-district cases. Money fraud should also be reported at once on the 1930 helpline and at cybercrime.gov.in. The police must receive information about a cognizable offence irrespective of where it occurred and register an FIR under section 173 of the BNSS.

Is there a cyber cell in every district of West Bengal?

Yes. Each district has a cyber cell attached to its police organisation to handle online fraud, financial cyber crime, identity theft and social-media harassment within that district. Serious, multi-victim or inter-district cases are handled by the state cyber crime police station in Kolkata, which coordinates tracing across districts and states. Offences within the city are handled by the Kolkata Police cyber unit.

What is the difference between a portal acknowledgement and an FIR?

A complaint on cybercrime.gov.in creates a national reference number and can trigger a bank freeze, but it is not by itself a registered FIR. An FIR is the record created under section 173 of the BNSS when a cognizable offence is disclosed, and it carries a crime number that the bank, the investigator and the court all recognise and act on.

What documents are needed for a cyber crime complaint?

You need photo identity, a dated and signed written complaint describing the sequence and amounts, bank or payment-app statements showing the transaction reference and beneficiary, full-page screenshots with the URL and account handle, device and OTP details, and the bank's acknowledgement of your fraud report. A complete complaint is registered faster and gives the investigating officer something concrete to act on.

Which court hears a cyber crime case in Kolkata?

The criminal work of the Magistrate in Kolkata city sits at the Chief Metropolitan Magistrate's court, commonly called Bankshall Court. Graver matters that must be tried by a Sessions court go before the City Sessions Court. Where an FIR discloses no offence or is an abuse of process, the accused may seek quashing before the Calcutta High Court under section 528 of the BNSS.

What if the police in West Bengal refuse to register my FIR?

If the officer declines to register an FIR, send the substance of the information in writing to the Superintendent of Police, which is the remedy preserved by section 173(4) of the BNSS. If that brings no action, apply to the jurisdictional Magistrate under section 175(3) of the BNSS, and the Magistrate may order an investigation into the matter.

How do I get my money back after online fraud in West Bengal?

Report immediately on 1930 and cybercrime.gov.in so the transaction can be flagged and a freeze request routed through the bank's nodal officer. Give the FIR crime number to your bank, which must act within the timelines set by the RBI directions on unauthorised electronic transactions. If the bank does not resolve it, escalate to the banking ombudsman while the police investigation continues.

Can the accused be arrested in a West Bengal cyber crime case?

For a cognizable offence carrying up to seven years, the police must ordinarily serve a notice of appearance under section 35 of the BNSS rather than arrest, and a person who complies and attends is protected from arrest unless the officer records reasons. For graver offences, arrest is possible, and the accused can seek bail or, where the FIR discloses no offence, quashing before the Calcutta High Court.
