Property disputes: the record is the case

Property litigation in West Bengal usually turns on documents rather than on oral testimony. The registered deed, the mutation record, the record of rights, and the municipal assessment together tell the court who owns what and who has been paying for it. Where those records conflict, the suit becomes a fight about which document prevails.

Matters handled

The documents that decide the suit

A title chain is proved through the registered sale deeds going back to a common ancestor or a government grant, the record of rights (khatian and porcha), mutation orders of the Block Land and Land Reforms Officer, municipal or panchayat tax receipts, and where relevant, the probate or succession certificate for inherited property. An agreement to sell is only enforceable if it is in writing, signed, supported by part payment, and not hit by limitation — the period is three years from the date fixed for performance.

Interim protection

Where a sale or construction is threatened, an application for injunction is filed with the plaint. Courts grant protection where the plaintiff shows a prima facie title and the balance of convenience, and where the defendant's conduct suggests the property may be alienated before the suit is decided. A caveat and a registration of the suit under Section 52 of the Transfer of Property Act are used to prevent a transfer from defeating the litigation.

Documents to keep ready

Frequently asked questions

What documents prove title in West Bengal?

The registered deeds in the chain of title, the record of rights, and mutation records. Municipal or panchayat tax receipts support possession.

Can a mutation entry be corrected?

Yes. An application lies before the Block Land and Land Reforms Officer, and a wrong order can be challenged before the higher revenue authority or the High Court.

What is the limitation for a partition suit?

A co-owner can seek partition at any time; the right is not extinguished by limitation, though accounts and improvements are adjusted.

How do I stop a sale of disputed property?

By filing a suit with an injunction application, and by registering a caveat and the suit itself so that any transfer is subject to the litigation.
